Terms of Service

Welcome to bybox.
These Terms of Service ("Terms") govern your use of the bybox mobile app, website, and all related services (collectively, the "Platform").
By accessing or using bybox, you agree to be bound by these Terms. If you do not agree, you must not use the Platform.
1. Who we are
Bybox is a digital platform created and operated by Bybox Labs Ltd, a Nigerian technology company registered under RC 8931210 and based in Abuja, Nigeria.
Bybox helps users send and receive cash gifts along with messages, using customizable templates for different moods and moments (birthdays, condolences, celebrations, anonymous play, hustle support, etc.).
Bybox is not a bank, wallet, or financial institution.
All payments and settlements are processed securely through licensed third-party payment partners (such as OPay), who handle payment authorization, settlement, and regulatory compliance in line with Nigerian financial regulations.
2. Eligibility
To use bybox, you must:
- Be at least 16 years old.
- Have legal capacity to enter into a binding agreement;
- Use your own valid phone number and accurate information;
- Use the Platform for lawful purposes only.
If you are under 16, you should use bybox only with the knowledge and consent of a parent or legal guardian.
We may suspend or terminate accounts that provide false information or violate these Terms.
3. Your account & security
To access bybox, you must create an account using your phone number and verify it via One-Time Password (OTP). You will then set a PIN (and optionally biometric login where supported).
You are responsible for:
- Keeping your OTP and PIN secret;
- Only using devices you trust;
- Immediately informing us if you suspect unauthorized access.
You must not share your OTP or PIN with anyone, including anyone claiming to be from bybox, OPay, a bank, or support.
If you think your account has been compromised, contact us immediately. We may temporarily block or reset your account to protect you.
Bybox is not responsible for losses resulting from you sharing your login credentials or failing to secure your device.
4. Messages, content, and behavior
Bybox allows you to send and receive messages attached to gifts and through various templates (events, plays, hustle, etc.).
We believe in privacy, and all messages are described in our Safety and Privacy documentation as protected and not used for advertising or profiling. However, you are fully responsible for the content you send or share.
You agree not to send, share, or post content that:
- Is abusive, harassing, threatening, or defamatory;
- Contains hate speech, discrimination, or incitement to violence;
- Is sexually explicit, exploitative, or harmful to minors;
- Promotes fraud, scams, gambling, money laundering, terrorism, or other illegal activity;
- Impersonates another person, brand, or entity without permission;
- Violates any third-party rights (including privacy, image rights, or intellectual property).
We may restrict, suspend, or terminate accounts that use bybox to harm others, misuse anonymous features, or violate these content rules.
5. Payments, balances & withdrawals
Bybox is designed for cash gifting, not general payments or commercial invoicing.
- When someone sends you a gift through your bybox link, the gross amount of that gift is first recorded in your bybox balance.
- Bybox charges a 5% service fee only when you withdraw your balance to your linked payout account (e.g., OPay wallet).
- 3.5% supports the operation, hosting, and security of bybox;
- 1.5% covers the transaction and processing fees of our payment partner(s).
Example:
If your bybox balance is ₦10,000 and you withdraw:
- ₦9,500 is paid out to your chosen payout method;
- ₦500 is retained to cover fees.
Bybox does not:
- Operate as a savings account;
- Pay interest on balances;
- Provide lending, investment, or credit services.
All monetary transactions are ultimately executed and settled by our licensed payment partners. Settlement times may vary due to bank or partner processing times.
You are responsible for any taxes due on amounts you receive through bybox, in line with the laws of your jurisdiction.
6. Fees & changes
Our current service fee for withdrawals is 5% of the amount withdrawn.
If we change our fee structure, we will:
- Update the information inside the app and on our website; and
- Make reasonable efforts to notify users in advance.
Any new fees will only apply going forward, not retroactively to completed withdrawals.
7. Refunds & disputes
Gifts are final.
Once a gift has been successfully sent and processed, it is not normally refundable, because it is a voluntary transfer from one user to another.
Refunds may be considered in rare cases such as:
- Duplicate payments caused by a technical error;
- Failed or reversed transactions confirmed by our payment partner.
If you believe a transaction was made in error, contact contact@bybox.me with details. Refunds are subject to investigation and the policies of our payment partners.
Bybox is not a party to personal agreements between users. If you have a dispute with another user (for example, regarding promises, personal arrangements, or expectations around gifts), you agree to resolve it directly with them. Bybox is not obligated to mediate or settle disputes between users.
8. Anonymous mode & safety
Anonymous messaging and gifting features are optional and meant for fun, honest expression, and lighthearted interaction.
You agree not to use anonymous features to:
- Bully, harass, or threaten others;
- Spam or scam;
- Spread hateful or harmful content.
We may limit, suspend, or permanently ban accounts that misuse anonymity or cause harm to other users.
We provide tools (hide, pause link, delete messages) to help you stay in control of your experience, as described on our Safety page.
9. Prohibited uses
You agree not to use bybox for:
- Money laundering or moving funds for criminal activity;
- Fraud, scams, or phishing;
- Unlicensed betting, gambling, or games of chance;
- Financing illegal activities;
- Collecting payments for banned products or services;
- Automated scraping, reverse engineering, or attacking our systems.
We may be required by law to report certain activities to regulators or law enforcement where we detect or suspect illegal use.
10. Privacy & data protection
Your use of bybox is also governed by our Privacy Policy, which explains how we collect, use, store, and protect your personal data.
By using the Platform, you consent to our handling of your data in accordance with that policy.

11. Intellectual property
All rights in the Platform — including the bybox name, logo, interface, design, and underlying software — belong to bybox Labs Ltd or our licensors.
You may not copy, modify, distribute, or create derivative works based on our brand or software without our written consent.
You retain ownership of the content you create (such as messages or captions), but you grant bybox a limited, non-exclusive license to display such content within the app (for example, in your inbox, stories, or history) solely to provide the service to you and your recipients.
12. Service availability & changes
We aim to keep bybox available and running smoothly, but we cannot guarantee uninterrupted access at all times.
Maintenance, upgrades, network issues, or outages at our partners may temporarily affect service.
We may modify or remove certain features, templates, or functionalities over time as we improve the Platform.
We are not liable for losses or inconvenience caused by downtime or feature changes, especially where they result from events beyond our reasonable control (such as power failures, internet issues, partner outages, or force majeure).
13. Account closure & termination
You may close your account at any time through the app's settings.
When you delete your account:
- Your profile, messages, badges, and personalized link are permanently erased;
- Certain transactional records may be retained for a limited time where required by law (for example, for fraud prevention or financial reporting).
We may suspend or terminate your account if we reasonably believe that you:
- Violated these Terms or other bybox policies;
- Used the Platform for illegal, fraudulent, or harmful activity;
- Abused anonymous features or harassed other users;
- Attempted to compromise our systems or security.
Where appropriate, we may also restrict withdrawals while investigating suspicious activity.
14. Third-party services
Bybox integrates with external services (such as payment providers, SMS gateways, app stores, and social platforms).
Your use of these services (e.g. OPay, Google Play, App Store, WhatsApp, TikTok, Snapchat, etc.) may be subject to their own terms and policies.
Bybox is not responsible for errors, downtime, or losses caused directly by those third-party services.
15. Limitation of liability
To the maximum extent permitted by law, bybox Labs Ltd and its directors, employees, and partners are not liable for:
- Any indirect, incidental, special, or consequential damages;
- Loss of profits, revenue, data, or goodwill;
- Losses arising from user disputes, misuse of the Platform, or illegal activity by third parties;
- Issues caused by circumstances beyond our reasonable control.
Our total liability to you for any claim relating to your use of bybox will not exceed the total fees you have paid to us (if any) in the 3 months prior to the event giving rise to the claim.
Nothing in these Terms excludes liability for fraud, willful misconduct, or any liability that cannot be excluded under Nigerian law.
16. Changes to these Terms
We may update these Terms from time to time (for example, when we add new features or respond to legal changes).
When we make material changes, we'll let you know through the app or by email. Your continued use of bybox after the updated Terms take effect means you accept the changes.
If you do not agree with the updated Terms, you must stop using the Platform and may close your account.
17. Governing law & disputes
These Terms are governed by the laws of the Federal Republic of Nigeria.
If we cannot resolve a dispute informally, it will be handled by the appropriate courts in Abuja, Nigeria, unless another process is required by applicable law.
